For residential property of no fewer than one and no more than four dwelling units, 'a designated broker acting as a single agent for a buyer ... shall enter into a written agency agreement.' For other property types the statute says a written agreement MAY be entered into — permissive, not mandatory. The agreement must include the § 76-2418 duties and responsibilities, the compensation terms, a fixed expiration date, and whether subagency offers may be made to other brokers.
